What happened on the set of Rust?
Rust is an indie Western film that tells the story of a 13-year-old boy who goes on the run with his grandfather, a notorious outlaw, after he is wrongly accused of murder. Alec Baldwin plays the grandfather, Harland Rust, and also serves as one of the producers. The film was directed by Joel Souza and written by him and Baldwin. The film had a small budget of $6–7 million and was Baldwin’s passion project.
The film began shooting on October 6, 2021, at the Bonanza Creek Ranch in Bonanza City, New Mexico, a ghost town located thirteen miles south of Santa Fe. Hannah Gutierrez-Reed was hired as the armorer for the film, along with her father Thell Reed, who was the property key assistant. According to the production’s weapons inventory, there were 16 firearms on the set, including six revolvers, four rifles, and six shotguns.
On October 21, 2021, the crew was preparing to film a scene in which Baldwin’s character points a revolver at the camera, which was operated by cinematographer Halyna Hutchins. According to the affidavit of the Santa Fe County Sheriff’s Office, Hannah Gutierrez-Reed set up three prop guns on a cart outside the church where the scene was taking place. She said that she checked the guns and they did not have any live rounds. She then left the cart unattended while she went to the bathroom.
David Halls, the first assistant director, picked up one of the guns from the cart and handed it to Baldwin, announcing that it was a “cold gun”, meaning that it was safe and unloaded. Baldwin took the gun and rehearsed the scene with Hutchins and Souza inside the church. He pointed the gun at the camera and pulled the hammer back. The gun fired a live round, which struck Hutchins in the chest and Souza in the shoulder.
Hutchins, 42, was airlifted to the University of New Mexico Hospital in Albuquerque, where she was pronounced dead. Souza, 50, was taken to the Christus St. Vincent Regional Medical Center in Santa Fe, where he underwent surgery and survived. Baldwin, 65, was questioned by the authorities and released. He was visibly distraught and cooperated with the investigation.
The shooting incident shocked the film industry and the public, and raised questions about the safety and ethics of using real guns as props in movies. It also revealed that there were multiple issues and complaints on the set of Rust, such as low wages, long hours, lack of COVID-19 protocols, and inadequate training and supervision of the weapons. Several crew members had walked off the set earlier that day, citing these concerns.
What are the charges and the trial?
The shooting incident was investigated by the Santa Fe County Sheriff’s Office, the New Mexico First Judicial District Attorney, the New Mexico Occupational Health and Safety Bureau, and the Federal Bureau of Investigation. On January 19, 2023, the Santa Fe district attorney announced that Baldwin and Hannah Gutierrez-Reed would be charged with two counts each of involuntary manslaughter, and in the alternative with two counts each of manslaughter. First assistant director David Halls agreed to plead guilty to the charge of the negligent use of a deadly weapon.
On January 31, 2023, Baldwin and HannahReed were formally charged with two counts of involuntary manslaughter. On February 23, 2023, Baldwin pleaded not guilty and on April 20, 2023, it was reported that prosecutors had informed Baldwin that the charges against him were being dropped. On June 22, 2023, Gutierrez-Reed was additionally charged with tampering with evidence and on August 9, 2023, she pleaded not guilty to both charges. Her trial is scheduled on February 21 through March 6, 2024.
On January 19, 2024, Baldwin was indicted again with involuntary manslaughter in the death of Halyna Hutchins and on January 31, 2024, he pleaded not guilty. His trial date is set for August 6, 2024.
If convicted, Baldwin and she could face up to 18 months in prison for each count of involuntary manslaughter, and up to nine years in prison for each count of manslaughter. Hannah could also face up to 18 months in prison for tampering with evidence.
In addition to the criminal charges, Baldwin and Hannah Gutierrez-Reed are also facing a civil lawsuit filed by the widow of Halyna Hutchins, Matthew Hutchins, on November 16, 2021. The lawsuit accuses them of negligence, wrongful death, and infliction of emotional distress. It also names Rust Movie Productions, the production company of the film, and several other individuals and entities involved in the film. The lawsuit seeks unspecified damages for the loss of income, companionship, and support of Halyna Hutchins, as well as for the medical expenses and pain and suffering of Joel Souza.
